Selling Viagra® and Cialis® in California, the U. S. Attorney’s Office announced today that the state of California has reached an agreement with the federal government for the purchase of the four generic versions of the erectile dysfunction medication. The agreements are intended to provide a legal defense against counterfeit or unlicensed generic products that are sold for recreational purposes, or to forfeit profits when their sale is not allowed, or to provide for additional legal penalties and other sanctions for those who may be affected.

In light of these allegations, the U. District Court for the Northern District of California has sentenced Dr. Scott Tiefer to serve an eight-year prison sentence for receiving counterfeit versions of Viagra®, Cialis® and Levitra® at a cost of $2.4 million to a state-appointed judge, and $2.3 million to the U. Attorney’s Office for the Southern District of California. The judgment will be appealed by the FDA, and will be discussed later in this release.

In September 2023, Judge Rebecca Doherty denied the motion for summary judgment on the basis that there is no evidence in the record that would support a finding that the medications are counterfeit or otherwise mislabeled. In a response, the FDA said it was satisfied that the four Viagra® and Cialis® versions sold in California were sold by manufacturers that were not authorized to sell generic versions of these medications.
Judge Doherty also rejected the contention that the products are “generic drugs,” noting that the FDA has not approved the four products because of the risk of harm posed by the alleged counterfeit versions of the drugs.
